After 2 years in a rent-controlled unit, landlord requests a 25% rent increase

2023.06.09 05:29 RuleThis2042 After 2 years in a rent-controlled unit, landlord requests a 25% rent increase

Seems like it's an old story at this point. I’ve read so many of them on reddit, wondering if it would happen to me, and it has. Emails are pasted below with identifying info removed.
First, I requested to have my wife added as a resident of the condo. Condo management kicked it back to my landlord for approval, which I didn’t think was required. Landlord tells me that they need to increase my rent due to their increased costs and financial troubles, sort of as an exchange to approve my wife’s occupancy, threatened to potentially occupy the unit themselves, however they moved overseas months ago. I’ve just refused, but I offered to help them out with a temporary payment outside of the tenancy agreement. Of course I’d like to continue living here. The emails fill in the details up to now. Looking for advice.
_________
Hello,
Congratulations on your marriage.
The first step is for us to receive approval from your landlord to add your wife as an additional resident in the unit. They are copied here and can do a “reply-All” to this email, or they may provide a Lease Amendment if they wish.
When we receive their approval, then we will send you the registration forms and information to get your wife setup on the system.
Thank-you.
Sincerely,
Property Administrator
__________
Thank you property administrator, Hi Landlord, I hadn't mentioned this because my understanding is that it's only for logistics at the condo (picking up packages, calling security, management etc.) After reviewing the LTB's Landlords, Tenants, Occupants and Residential Tenancies Interpretation Guideline 21 and seeking professional advice, I determined that my wife is considered a "spouse of the tenant" and occupant of the unit, but there's no requirement for her to be on the lease. The legal relationship of landlord-tenant remains between you and me. I hope to have your blessing to ease this process with the condo management.
All the best, Tenant
_________
Dear Tenant, First of all, I wanted to extend my heartfelt congratulations on your recent marriage. I sincerely wish you and your spouse a lifetime of happiness together. I am writing to discuss an important matter regarding the approval of your spouse as a resident in our system. While you are correct about the existing rules and regulations, I would like to request a favor before granting this approval. During my vacation overseas, I received the unfortunate news that I have been diagnosed with cancer. As a result, I had to prolong my stay here to undergo treatment. This unexpected turn of events has had a significant impact on my businesses in Canada, causing a disruption in my income. Furthermore, I have been faced with increased maintenance expenses and mortgage costs, which have put me in a financially burdening situation. Given these circumstances, I must reluctantly ask you to consider an increase in rent. Let me clarify that I have never requested a rent increase beyond the guidelines set by the government. Our longstanding relationship and the fact that you have been living alone have been key factors in maintaining our good rapport over the years. However, considering the current situation, it has become unavoidable to raise the rent or consider moving into the unit myself. I am hopeful that with your recent marriage and the added financial support from your spouse, you would be able to assist me by paying the revised rent amount. I want to emphasize that this decision has not been made lightly, and I understand the inconvenience it may cause you. The proposed new rent amount is $2700.00, effective from July 1st, 2023. This revised amount takes into account the increased maintenance expenses and mortgage costs that I am currently facing. To provide you with further context, I have attached information on the recent rental prices of neighboring units. This data shows that the offered amount is both reasonable and below the current market price. I genuinely value you as a tenant and appreciate the care you have taken of the property throughout your tenancy. I understand that this rent increase may impact your budget, and I am more than willing to address any concerns or questions you may have. Thank you for your cooperation and understanding in this matter. Sincerely, Landlord
__________
Hello Landlord,
I'd like to say again that I'm sorry to hear about your health and business challenges. I have close family and friends with cancer. I know how painful that has been for my loved ones. And, like you, my wife and I are adjusting to higher mortgage costs on a property while our income has not kept pace. For that reason, I must decline your request for a 24.1% increase in rent following a 2.5% increase two months ago.
A tenancy agreement contract comes with risk for both parties, and I had to factor that risk into my financial plan. I sought a rent controlled unit to mitigate it. I believe that rent controls in Ontario exist to protect renters from sudden increases in rent. They are not to be simply dismissed when the landlord wants to pass their unexpected financial burden onto their tenant.
I'm not sure if you were implying a quid pro quo: approval of my wife's occupancy in exchange for increased rent. I may have understood that, but that would be inappropriate under the law and its interpretation in Ontario. My apologies if I misunderstood. I am also concerned about you stating that a key factor in our “good rapport” is my residing alone in the unit. I pay for the right to occupy the unit, and as long as I don't violate overcrowding bylaws, I may have other occupants. The law is quite clear on this. I believe that the good rapport we have shared is based on each of us fulfilling our obligations under the contract, our courteous and timely communication, and our willingness to help one another on occasion beyond the terms of our contract.
I hope to share my perspective with you in the next two paragraphs. Though you may see your previous rent increases to the guideline maximum as a good faith gesture, I see them as simply following the law. In fact, you increased the rent as much as you possibly could. A good faith gesture would have been an increase below the guideline or no rent increase at all. I write this not because I expected zero rent increase, but so you understand what I hear when you say, "Let me clarify that I have never requested a rent increase beyond the guidelines set by the government." You are stating that you've never requested something that you are not allowed to request, which I don’t consider to be a favour. Now you are requesting that very thing.
I acknowledge and appreciate that you have never invaded my privacy, and you have always been respectful in your communication with me. I have given you that, and more. I have gone beyond my responsibilities as a tenant on many occasions, saving you money by avoiding the need for expensive contractors and property management. You’ve only sent someone once: a plumber after I spent my time and money trying to fix the problem. As far as I know, you’ve only been to the unit once yourself during my tenancy, which was with the plumber. When the unit above leaked and destroyed the front closet, you never came. I dealt with building management, and I donated my labour to fix the water damage to the wall and the coat rack. I have repaired and repainted all the walls of your unit with the original paint at my expense. I have stripped and re-caulked your bathtub because it was growing mould and had gaps that were allowing water to get under the tub. There have been other issues that I can assure you other landlords would have been called to address: HVAC problems, neighbouring balcony leaking problems, clogged drains, noise problems and more. You dismissed your property manager and moved to the other side of the globe. If that’s not recognition of the value I provide you, I’m not sure what is. I think our good rapport is based on my many gifts to you in the form of my time and money. It is based on me dealing with problems that landlords are legally responsible for.
Your request to increase my rent by nearly 25% with 23 days notice of the first new payment is inappropriate in the extreme. It is 10 times the annual rent increase guideline. It follows a rent increase of 2.5% only two months ago. And, it's 1/4 of the minimum 90 days notice for a legal rent increase. I realize this is a request, not a notice, nevertheless it is an enormous increase with little warning, and it’s attached to the threat that you will evict me if I don't agree. It is an unreasonable demand that puts me under duress, and that would cause me undue hardship. I also have no guarantee that you would not do the same thing again later if I acceded to your demand.
Ultimately, I understand and respect your right to occupy your unit. I imagine that you understand and respect my need to verify that occupancy for the required period after my hypothetical eviction. I am in a position to verify who is living there, whether the unit is rented again or not, and to pursue any legal action that would follow.
With all that said, if you would allow me to do a detailed review of your finances, I would consider agreeing to a rent increase. This would have to occur with at least 90 days notice, in accordance with a legal rent increase.
Alternatively, I would be amenable to a temporary extra monthly payment to help you get through these difficult health and business circumstances. There would be no change to our tenancy agreement. We could at both parties’ discretion revise and renew the agreement at the end of its period. I would be happy to put such an agreement into writing.
I would like us to speak on the phone or an online platform like WhatsApp because I feel we can come to an agreement that is legal and beneficial to us both. I fear that a contentious end to our relationship would be very taxing financially, emotionally, and time-wise. Nevertheless, I believe strongly in what is right, in my rights as a tenant, and in your responsibilities as a landlord. I am prepared to see whatever process we enter to the very end.
Regards,
Tenant

2023.06.09 05:20 cjmss AITA for not chipping in for family vacation

Brothers family, sisters family, and parents all rent a house together for a week long vacation. I’m in the military and live out of state, so often I am unable to attend family events. No one tells me the plans for this vacation rental or asks me if I am available to go.
About a month before the vacation, after all plans are set and house is paid for, my mom mentions that the family will be taking this vacation and invites me to come for the week or a few days if I am available. I am available for the first half of the week and tell her I’ll be there for 3 days, 2 nights. No other family members have communicated with me about this at all.
I show up, after a 7 hour drive, and there is obvious tension with my brother. It comes to light the second day that he is resentful that I’m staying in the house without having chipped in money for my fair share. I argue that i wasn’t made aware or involved in the planning, no one asked me if I could go (until mom did), and after I was invited no one mentioned money until after I got there.
I packed my shit and left, feeling like I wasn’t welcome. Am I the asshole??

2023.06.09 04:34 AngryExsEx I just left for a vacation, and home stresses followed me.

Venting... if anyone has any wisdom to share, by all means, please do so.
Right now it's so hard to not try to find a dispensary. In fact, not getting a rental car until tomorrow might have saved me from getting high again.
I'm on a solo trip while my kids are at their mom's house for their weekend with her... I have them 10/14 days, she had them the other 4. Our teenage son is going through a rough spell to end the school year, with this week being especially difficult. Today he had a bit of a meltdown, and his mom isn't (IMO) emotionally equipped to handle it, and on top of that is blaming me for setting her up to fail. So I feel like I let everyone down and her I am on vacation.
I just want to escape right now. Bury my head in a pillow, my lungs in that nasty smoke, and go somewhere else.
But instead, I'm literally somewhere else, with one specific goal of the trip to quit forever, or at least get a 3 day head start on it so when I get home I've increased my odds of success.
End vent. If you got here, thanks for letting me share some of the load from these burdensome emotional bricks.

Trying to enroll in Aadvantage program
For the last 2 days I've been trying to sign up for the Aadvatage program. I've tried about a dozen times and every time I get this error. I've closed browsers, tried new browsers, restarted. I'm convinced it's not my fault anymore. Anyone else have issues? At first it wasn't a huge deal. Now it's getting annoying. It doesn't seem to bode well for them if they can't even get their enrollment to work. Is it worth all the hassle?

2023.06.09 03:28 mhm94 Renting vs owning when family planning

I hope this is allowed, I'm not quite sure where else this fits otherwise. Essentially my husband and I are looking to start a family this year, we currently rent our home in Ontario, but are open to buying anytime. We've basically been fence sitting for the last few years, keeping an eye on the market, hoping it would go down but it hasn't and it's instead done the opposite. I find renting to be unstable as I don't have the control as to whether or not the roof over my head stays mine, a landlord does. Anytime he could say, we've sold the place, the buyer wants vacant possession and legally I would have 60 days to vacate the premises. This would force us to either rent another place (sign new lease and be locked in for a new lease term, probably 1yr) or buy immediately regardless of the prices. My issue is the instability of being in a rental with a child, I feel much more comfortable and confident when the bare minimum I need to provide as a parent, is something I control and have full oversight of. How does one overcome these concerns? Keeping in mind having a child would also mean removing the buying option as mortgage qualification on the miniscule mat leave pay would make buying impossible. I'm not looking for predictions on what the market would do, just moreso advice on stability and any clarification on things I might not be thinking about when looking at this picture. I know real estate is always going to be a gamble but since we can never be certain it will be a great investment, that risk will always exist and I'd simply rather jump before a child arrives (obviously calculating affordability based on our expected combined income during mat leave). Thanks for any advice in advance!

2023.06.09 02:14 Tight_Abalone_9193 Property won’t take rental assistance

So first to say, this is in North Carolina. I am in the eviction due to not being able to find a stable job. I recently went to court and the judge and lawyer representing the property said I could pay my debt with the help of rental assistance. So I go to my leasing office today to pay my rent and the people at the desk told me that they couldn’t and wouldn’t take my rental assistance (2 days after the court hearing). So now I’m in a pickle here and I don’t know what to do or who to call or go to since I only have 8 days to pay or vacate…Any advice?

2023.06.09 01:32 theoriginalshabang1 Can anyone help to explain what this means in my lease agreement?

Hello there! Appreciate in advance if you read this long post!
My building sold & new landlord has a new lease with some language I want to be sure that I understand. He is notorious here for not being a great person, pushing off anything he can & basically a slumlord, so I just want to be clear what I am signing. Located in the USVI & the local gov't site regarding tenant/landlord equates to 6 bullet points... not helpful.
I called multiple attorneys in the area & of those that replied, they only represent Landlords - not Tenants, so I am still trying to find a local attorney to advise.
Can someone explain it like I'm 5, please?

Does this mean that he could have taken a 10 year variable APR mortgage on the building and he could increase our rent mid-lease?

USVI Notice to Quit is 30 days in advance. In another part of the lease, rent is due on the 1st, with daily charges incurring after the 6th. Could he give us a termination letter on the 2nd?

Wut? I'm supposed to only care about his interests if there is an issue? What does this even mean?

Is this even legal to ask us to take out a policy naming him?? So, he doesn't have to hold insurance if someone gets injured, but all of the tenants have to get a policy naming him?

If you have stuck with me so far, thank you!! I really appreciate any advise you can give!!

2023.06.09 00:22 YoooWhatsGooood Advice on a refund request (as a guest)

Edit: TLDR Host didn't provide listed amenities. Airbnb won't do anything because host only communicated with me via text and is denying everything.
My family and I recently stayed at a home in Hawaii that lacked listed amenities, the most notable of which was wifi. The host did not let us know before we arrived that the wifi had been disconnected and it was only after our first night that I asked and was told they were changing ownership and had not gotten new wifi installed. I was told by the person I was in contact with that their hands were tied as they were only the groundskeeper but they would pass along my concerns to the host. I was very annoyed that I wouldn't be able to do remote work I had planned on doing and some kids on the trip missed online school-work. However, I figured I'd simply try to enjoy my vacation otherwise and try to resolve it later as I was stressed about other things having gone wrong (issues with car rental and delayed flights, etc). After our stay, I requested a partial refund which was denied and elevated to airbnb support who said that, despite having uploaded proof there was no wifi, they couldn't do anything because I never made a formal request via the app for the host to resolve my issue. Additionally, they couldn't verify my messages with the groundskeeper were legitimate because they had contacted me via text (and the host just denied it). Is there anything else I can do or am I just completely screwed for not having communicated via the app? I'm thinking of suing the host, but only as a last resort if I have no other options.

2023.06.08 22:32 ThrowRA_some_major I [36m] don't want my wife's [33f] parents to visit our children.

I [36m] don't want my parents-in-law to visit my children anymore after they victim-blamed my foster child.
A bit of background: My foster son was placed with my brother-in-law first. But I had a gut feeling that my BIL was, at the very least, being inappropriate with him and, at worst, abusing him. I made a post on another sub a couple of weeks ago and some comments told me to just be there for him so I started to work to provide an emotionally safe place for him and kept on treating him like my nephew. But one time after I took him and my children to the movie theater, he waited for my children to get out of the car before he tried to unzip my zipper, I quickly stopped him, and I believe he might have confused my intentions, when I stopped him he looked at me confused and embarrassed before he started to apologize profusely. He told me that he thought that's what I wanted. I asked him if anyone has ever asked him to do that but he swore no one had.
I was already worried about him but after that incident, my worries only intensified even more. I kept a close eye on him, kept telling him that he could tell me anything, and if he ever needed any help I was going to be there for him. Life had been pretty normal aside from that incident, my BIL and he kept visiting us and we would have brunch with everyone on Sundays. For Memorial's weekend, we went on a short vacation and we shared a rental again, I kept a close eye on FS, he seemed to be having plenty of fun and was enjoying the vacation. There was one time when BIL and FS went out to get a treat with just the two of them and when they came back FS's behavior was different for a short time before he went back to spend time with my children. I pointed out to my wife that I found it strange how his behavior would change every time they would go out somewhere by themselves but my wife told me to drop it and that was FS being a typical teenager.
But everything changed last week right after Memorial weekend, my BIL was arrested for the distribution of CP and CSA. We were asked if FS could move in with us and we agreed. Things have tense within the family. But we all are trying to survive and process what has been going on
My parents-in-law came to visit this Tuesday, and while we were having dinner, my MIL said how much she missed her son, I found the conversation inappropriate since FS was right there and I interrupted her, but after I interrupted her, she said to the table that her son would be with us if FS hadn't seduced him. I had a conversation with her about how that was inappropriate and harmful, but she kept talking about how she knew "that boy" was going to be trouble the moment she met him. She's convinced FS is lying and she said that "those children are known to lie to manipulate."
After that, I told my wife I don't want them to visit anymore because it wouldn't be fair for FS and how it's now our job to protect him and be there for him. But my wife says that would be too far and unfair for her parents since they are too trying to process what just happened and it wouldn't be fair to keep them from their grandchildren.
I think it would be great if my parents-in-law would work on themselves before they are around our children. I'm not trying to harm my children's relationship with their grandparents in any way. I'm trying to protect my foster son while he's at a very vulnerable place.
I have been trying to help my wife understand where I'm coming from and that I do want for our children to see and have a relationship with their grandparents but that they can't be around for the time being but I don't know how to send that message across. I've been trying to but I don't think she quite understands what I'm trying to say.
How do I reassure her that this would be temporary as long as her parents work on themselves? How can I get my message across while also validating her feelings and opinions?

2023.06.08 21:52 themightydudehtx Family of 5 - WDW Trip May 25 - June 4'th report

Background:
We are a family of 5 with my wife and I, along with my 7 yr old and 6yr old daughters and then my 3 yr old boy. They have been to disneyland before, but I'm not sure if they really remember it as it was 3-4 years ago, and my son wasn't even around. We did go to AK 2 years ago as we were in tampa staying on the beach for vacation when hurricane elsa was coming, so we made a quick 2 night escapae to disney world and were able to get a park reservation for AK for 1 day. I'm not really counting that though as their first trip to WDW. In my mind this is their first trip as we got to do everything
Travel:
We skipped out on the last day of school on May 26'th for my kids and caught a 11 am flight that morning out of Houston and got to Orlando around 1:45 PM or so. I surprised the kids with a limo for the ride to the hotel (they've been begging to ride in one for quite a while so figured why not for this special trip).

Hotel:
For this trip we decided on staying at Caribbean Beach Resort. We got a preferred room w/5th sleeper. I was using touring plans for this trip to help with the plans / hotel requests and what not and had requested a room in barbados closer to the main road that runs by the sky liner. That room request was sent in, but unfortunately we did not get that request. Instead we were put in Martinique which ended up being roughly a 8 minute walk to the Riviera skyliner station or 10-13 minute walk to the CBR skyliner station. Overall it wasn't bad, but I really wish I could of gotten that barbados request as it would of put us within a few minutes walk of the CBR skyliner station and still been relatively close to the main area of the resort. Overall though I was fine with the room. It was what I had booked and the bonus was the beds were the ones that had the space underneath them for the luggage. I had read / watched videos that said some of the CBR beds had the old style bed frames where you could not put your luggage under the bed and with us having 5 bags, that was going to make it tight in the room. So with being able to store the bags under the bed was very nice to have.
My thoughts on this resort is that it is nice and still in the process of being refurbished, but I had 0 complaints here. Skyliner is a big plus here, and I recommend getting close as you can to the CBR skyliner station for the convenience of getting to Epcot and Hollywood studios. If you get on the skyliner at the CBR station you do not have to get off the skyliner when it hits the riviera station. However, if you get on the Riviera skyliner and go to hollywood studios, you will have to get off at the CBR station then back on, so this could delay you getting to HS if you were trying to rope drop. With that being said we did this both ways and never had an issue.
Food at CBR was just fine. Quick service had some decent options for food besides your standard chicken strips / pizza. My personal favorite option they had was a pork carnitas with rice/black beans.

Parks:
Out of our 10 vacation days we had a total of 6 park days. Originally it was just 5 park days, but it was only like an extra $150 or so to add a extra day so we took that for a total of 6 days. Our schedule looked like this:
Thursday May 25: travel day
Friday May 26: HS/Epcot
Saturday May 27: MK
Sunday May 28: Epcot
Monday May 29: Rest Day
Tuesday May 30: AK
Wed May 31: HS
Thursday June 1: Rest Day
Friday June 2: MK
Saturday June 3: Rest Day
Sunday June 4: travel day

I was going to into more detail on all the days, but realized this was going to be a crazy long post. So instead I will just summarize.

We rope dropped all 6 days and 5 of the days we stayed till closing time.
We bought genie plus for all 6 days. We also did virtual queue and ILL to ride Tron twice. Amazing ride..highly recommend it. We did an ILL for guardians..again an awesome ride and highly recommend it.
We were able to hit every ride we wanted with minimal wait times due to the lightning lanes. I think the longest wait we had was 10-15 minutes. The Genie plus + ILL + Rope dropping made it easy hit the most popular rides in each park in the first couple of hours. I realize it's not feasible for everyone to get genie plus every day, but I had budgeted for it and I wasn't looking forward to waiting in line for an hour on some rides with my 3 kids.
We did Bibbidi Bobbidi Boutique for my 3 kids on our second day @ MK. The girls absolutely loved getting dressed up(we brought dresses my wife and bought) and having their hair / makeup done. We did the prince package for my 3 yr old and he was super excited to get his sword and shield. Awesome experience here for them.
My main disappointment was it seemed that most of the star wars stuff was in B mode and that was with a morning ride. For example doing RoR around 9:30 AM, There was no bb8, no rey, and Kylo was B mode. Then doing Smugglers Run, there was no hondo. Thankfully the second day we were at HS, we had BB8 / Rey and Hondo back on smugglers, but Kylo was still B mode, and again that second day was in the morning.

Food:
We did the following table service restaurants
Chef Mickeys:
Topolinos Terrace
Yak and yeti
Boathouse (disney springs)

Boathouse was a great start to our trip. That was dinner for us on arrival day.

Chef Mickeys was ok..nothing great, standard buffet food, but of course we are there for the characters.
Topolinos was probably my favorite plus the view was awesome.
Yak and yeti was good, plus sitting down in the shade and air conditioning was very welcome after walking around AK for a few hours.

Overall thoughts: I thought the parks were going to be busier than they were over memorial day weekend, but it seems we lucked out.
We 100% lucked out with the weather with only a day or 2 barely in the 90's. Most of the days were the 80s' which is definitely tolerable. We also managed to avoid any crazy rain showers while at the park. We got a little rain here and there but nothing that soaked us.

We used the Disney Minnie Vans a few times, and these things were awesome. We used them a couple times to get to the parks in the morning. Was nice to just book one and know we had 10, 15 minutes till it showed up. We actually made it to MK one day before the buses for opening and were there before security even opened up to let us through. Super convenient, but a little pricey. From CBR to the parks I think we averaged around $30-$40 one way with them.

Overall we had a great time. The kids did great as we only brought a stroller for the 3 yr old, the 6 and 7 yr old we had walk and they chugged along just fine with us. Albeit at the end of the night there were many requests to "hold me", but overall they did awesome. We did generally go back to the hotel room for 2-3 hours each day. The only park did we did not do that was at Animal Kingdom

2023.06.08 21:02 Lightspeed851 Rideshare or taxi from Ft. Amherst to Downtown

I don't believe St. Johns has UbeLift, correct? I'm looking at a one month vacation rental near Ft. Amherst this summer and was trying to avoid renting a car. Any idea what taxi fare would be from Ft. Amherst to Water st. area?

2023.06.08 20:58 matchettehdl Unpump your tires?

I'm in vacation in Iceland until next week with my family. On the way back from one of the cool caves with those awesome rock formations and ice, the pressure on a tire on our rental car started to decompress, and so we tried to pump it back up. We found a pumping machine, but it also had an option to suck the air out of your tire rather than putting air in your tire. Can I just ask why anyone would want to unpump your tire?

2023.06.08 20:36 999NERO999 Whats should i do in orlando what not?

Hello first of sorry for my english, i am not a native speaker. Which brings me to my point: in like one year we're going to vacation in Orlando.
I am already really exicited and want to get some insights on orlando and american culture in general. I am from Germany.
What should you do and not do in Orlando? How is public transit there? What should i look out for? Are rental cars affordable there? While i'm already there, is there any other city/place worth visiting close to orlando? Are there ghettos/hood where we should stay away from?
Some general do's and dont's in america?
Thank you in advance
